Fees Payable Under Ontario Regulation 31/05 (MEat)

Interpretation

1. (1) In this Part,

“holiday” means,

(a) any Sunday,

(b) New Year’s Day,

(b.1) Family Day,

(c) Good Friday,

(d) Victoria Day,

(e) Canada Day,

(f) Labour Day,

(g) Thanksgiving Day,

(h) Christmas Day,

(i) December 26; (“jour férié”)

“licensing period” means the period for which a licence is valid; (“période de validité du permis”)

“meat regulation” means Ontario Regulation 31/05 (Meat) made under the Act. (“règlement sur les viandes”) O. Reg. 223/05, s. 1 (1); O. Reg. 569/07, s. 1; O. Reg. 402/10, s. 1.

(2) Where this Part requires a calculation be made with reference to a number of hours, the number of hours shall be rounded to the nearest quarter hour.  O. Reg. 223/05, s. 1 (2).

Supplementary inspections

2. (1) For every inspector who performs supplementary inspections at a slaughter plant under subsection 57.2 (1) of the meat regulation, the operator of the plant shall pay a fee of,

(a) $20 for every hour that the inspector performs supplementary inspections on a day other than a holiday; and

(b) $25 for every hour that the inspector performs supplementary inspections on a holiday.  O. Reg. 168/09, s. 1.

(2) Despite subsection (1) and subject to subsection (3), the operator of a slaughter plant who, at the end of any one year period that begins on April 1 of any given year, has paid, in full, all the fees for which the operator is liable under this Regulation, is not required to pay the fee set out in subsection (1) in respect of the first time supplementary inspections are performed at the plant in the subsequent one year period on a day other than a holiday. (3) The exemption described in subsection (2) does not apply with respect to hours of supplementary inspections performed on the day referred to in subsection (2) that are in excess of eight hours. O. Reg. 286/13, s. 1.

Supplementary inspections — veterinary inspectors

3. For every veterinary inspector who performs inspections at a plant under subsection 57.2 (3) of the meat regulation, the operator of a plant shall pay a fee of $40 for every hour that the veterinary inspector performs the inspections.  O. Reg. 168/09, s. 3.

Fees re: provisional authorization to slaughter

3.1 (1) The fee payable by the operator of a slaughter plant specified in a provisional authorization issued under the meat regulation to slaughter one or more food animals outside of a slaughter plant is $25.  O. Reg. 328/06, s. 1.

(2) The fee payable by the operator of a slaughter plant specified in a provisional authorization issued under the meat regulation to slaughter one or more food animals outside of a slaughter plant is $48 per hour on a day other than a holiday and $65 per hour on a holiday for every hour that an inspector who is not a veterinary inspector,

(a) travels to the location of slaughter specified in the provisional authorization;

(b) attends at that location to perform an ante mortem inspection of the animals, supervise slaughter and perform other duties related to the provisional authorization; and

(c) travels from that location to the operator’s plant for the purpose of conducting a post mortem inspection of the carcasses of the animals.  O. Reg. 328/06, s. 1.

(3) The fee payable by the operator of a slaughter plant specified in a provisional authorization issued under the meat regulation to slaughter one or more food animals outside of a slaughter plant is $80 per hour for every hour that a veterinary inspector,

(a) travels to the location of slaughter specified in the provisional authorization;

(b) attends at that location to perform an ante mortem inspection of the animals, supervise slaughter and perform other duties related to the provisional authorization; and

(c) travels from that location to the operator’s plant for the purpose of conducting a post mortem inspection of the carcasses of the animals.  O. Reg. 328/06, s. 1.

(4) The fee payable by the operator of a slaughter plant specified in a provisional authorization issued under the meat regulation to slaughter one or more food animals outside of a slaughter plant is $40 for every hour that a veterinary inspector attends at the operator’s plant to conduct a post mortem inspection of the carcasses of the animals.  O. Reg. 168/09, s. 4.

Other services

4. For every inspector who performs services at a meat plant under section 57.3 of the meat regulation, the operator of the plant shall pay,

(a) $48 for every hour that the inspector performs services on a day other than a holiday; and

(b) $65 for every hour that the inspector performs services on a holiday.  O. Reg. 223/05, s. 4; O. Reg. 168/09, s. 5.

Application for licence

5. The fee for an application for the issuance or renewal of a licence under section 6 of the meat regulation is $300.  O. Reg. 402/10, s. 3.
