ONTARIO REGULATION 830/93

REGISTRATION

This Regulation is made in English only.

1. The following are prescribed as classes of certificates of registration:

1.  General.

2.  Academic.

3.  Educational.

4.  Emergency. O. Reg. 830/93, s. 1; O. Reg. 276/23, s. 1.

2. (1) A person may apply for a certificate of registration by submitting a completed application in the form provided by the Registrar together with the application fee.  O. Reg. 830/93, s. 2 (1).

(2) The application fee is non-refundable.  O. Reg. 386/06, s. 1 (1).

(3) It is a requirement for the issuing of a certificate of registration that the applicant pay the required applicable annual fee.  O. Reg. 386/06, s. 1 (2).

(4) Revoked:  O. Reg. 386/06, s. 1 (3).

3. (1) The following are general requirements for a certificate of registration of any class:

1.  The applicant must be able to speak and write either English or French with reasonable fluency.

2.  The applicant must not have been found guilty of a criminal offence, an offence under the Controlled Drugs and Substances Act (Canada) or the Food and Drugs Act (Canada), or any other offence relevant to suitability to practise chiropody.

3.  Where the applicant has been registered or licensed in Ontario in another health profession or has been registered or licensed in another jurisdiction in chiropody or another health profession, the applicant has not been the subject of a finding of professional misconduct, incompetence or incapacity.

4.  Where the applicant is registered in Ontario in another health profession or is registered or licensed in another jurisdiction in chiropody or another health profession, the applicant is not the subject of any current professional misconduct, incompetence or incapacity proceeding.  O. Reg. 830/93, s. 3 (1); O. Reg. 92/12, s. 1.

(2) The applicant shall be deemed not to have satisfied the requirements for a certificate of registration if the applicant made a false or misleading statement or representation in his or her application.  O. Reg. 830/93, s. 3 (2).

4. (1) The following are specific requirements for a General certificate of registration:

1.  The applicant must have successfully completed a post-secondary program approved by the Council whose curriculum includes courses in health sciences, chiropodial sciences, humanities and clinical education that, in the opinion of the Council, are relevant to the scope of practice of the profession.

2.  The applicant must have successfully completed the examinations set or approved by the Council.

2.1  The applicant must have successfully completed a jurisprudence examination set or approved by the Council.

3.  The applicant must have engaged in clinical practice for a total of at least three months during the two years immediately preceding the date of the application.

4.  Where, in the opinion of the Registration Committee, the program that the applicant completed is deficient in one or more aspects, the applicant must give a written undertaking to the College whereby he or she agrees to abide by any terms, conditions and limitations imposed by the Registration Committee on his or her certificate of registration until the applicant meets the educational requirements set by the Registration Committee.

5.  The applicant must be a Canadian citizen or a permanent resident of Canada or authorized under the Immigration and Refugee Protection Act (Canada) to practise the profession in Canada.  O. Reg. 830/93, s. 4 (1); O. Reg. 92/12, s. 2.

(2) The requirements for a General certificate of registration in paragraphs 1, 2 and 4 of subsection (1) are non-exemptible.  O. Reg. 830/93, s. 4 (2).

(3) The requirement in paragraph 3 of subsection (1) does not apply to an applicant who successfully completed the program described in paragraph 1 of that subsection within the two years preceding the date of the application.  O. Reg. 830/93, s. 4 (3).

(4) A member who holds an Emergency certificate of registration or a former member who held an Emergency certificate of registration within one year of applying for a General certificate of registration and who practised chiropody or podiatry for at least 180 hours while holding an Emergency certificate of registration is exempt from the examination fee for the competency examination. O. Reg. 276/23, s. 2.

4.1 (1) Subject to subsection (2), if an applicant already holds an out-of-province certificate that is equivalent to a General certificate of registration issued by the College, the applicant is deemed to have met the requirements set out in paragraphs 1, 2, 3 and 4 of subsection 4 (1).  O. Reg. 92/12, s. 3.

(2) It is a non-exemptible registration requirement that an applicant referred to in subsection (1) provide one or more certificates or letters or other evidence satisfactory to the Registrar or panel of the Registration Committee confirming that the applicant is in good standing as a chiropodist or podiatrist in every jurisdiction where the applicant holds an out-of-province certificate.  O. Reg. 92/12, s. 3.

(3) Without in any way limiting the generality of subsection (2), being in “good standing” with respect to a jurisdiction shall include the fact that,

(a)  the applicant is not the subject of any discipline or fitness to practise order or of any proceeding or ongoing investigation or of any interim order or agreement as a result of a complaint, investigation or proceeding; and

(b)  the applicant is in compliance with all continuing competency and quality assurance requirements of the regulatory authority of the jurisdiction.  O. Reg. 92/12, s. 3.

(4) An applicant referred to in subsection (1) is deemed to have met the requirement of paragraph 1 of subsection 3 (1) if the requirements for the issuance of the out-of-province certificate included language proficiency requirements equivalent to those required by that paragraph.  O. Reg. 92/12, s. 3.

(5) Despite subsection (1), an applicant is not deemed to have met a requirement if that requirement is described in subsection 22.18 (3) of the Health Professions Procedural Code.  O. Reg. 92/12, s. 3.

5. (1) The following are specific requirements for an Academic certificate of registration:

1.  The applicant must have successfully completed post-secondary program approved by the Council whose curriculum includes courses in health sciences, chiropodial science, humanities and clinical education that, in the opinion of the Council, are relevant to the scope of practice of the profession.

2.  The applicant must have an appointment to the faculty for a post-secondary program in Ontario described in paragraph 1.

3.  Where, in the opinion of the Registration Committee, the program that the applicant completed is deficient in one or more aspects, the applicant must give a written undertaking to the College whereby he or she agrees to abide by any terms, conditions and limitations imposed by the Registration Committee on his or her certificate of registration until the applicant meets the educational requirements set by the Registration Committee.

4.  The applicant must be a Canadian citizen or a permanent resident of Canada or authorized under the Immigration and Refugee Protection Act (Canada) to accept the appointment described in paragraph 2.  O. Reg. 830/93, s. 5 (1); O. Reg. 92/12, s. 4.

(2) The requirements in paragraphs 1, 2 and 3 of subsection (1) are non-exemptible.  O. Reg. 830/93, s. 5 (2).

5.1 (1) Subject to subsection (2), if an applicant already holds an out-of-province certificate that is equivalent to an Academic certificate of registration issued by the College, the applicant is deemed to have met the requirements set out in paragraphs 1 and 3 of subsection 5 (1).  O. Reg. 92/12, s. 5.

(2) It is a non-exemptible registration requirement that an applicant referred to in subsection (1) provide one or more certificates or letters or other evidence satisfactory to the Registrar or panel of the Registration Committee confirming that the applicant is in good standing as a chiropodist or podiatrist in every jurisdiction where the applicant holds an out-of-province certificate.  O. Reg. 92/12, s. 5.

(3) Without in any way limiting the generality of subsection (2), being in “good standing” with respect to a jurisdiction shall include the fact that,

(a)  the applicant is not the subject of any discipline or fitness to practise order or of any proceeding or ongoing investigation or of any interim order or agreement as a result of a complaint, investigation or proceeding; and

(b)  the applicant is in compliance with all continuing competency and quality assurance requirements of the regulatory authority of the jurisdiction.  O. Reg. 92/12, s. 5.

(4) An applicant referred to in subsection (1) is deemed to have met the requirement of paragraph 1 of subsection 3 (1) if the requirements for the issuance of the out-of-province certificate included language proficiency requirements equivalent to those required by that paragraph.  O. Reg. 92/12, s. 5.

(5) Despite subsection (1), an applicant is not deemed to have met a requirement if that requirement is described in subsection 22.18 (3) of the Health Professions Procedural Code.  O. Reg. 92/12, s. 5.

6. (1) The following are specific requirements for an Educational certificate of registration:

1.  The applicant is,

i.  enrolled in Ontario in a post-secondary program approved by the Council whose curriculum includes courses in health sciences, chiropodial sciences, humanities or clinical education that, in the opinion of the Council, are relevant to the scope of practice of the profession, or

ii.  engaged in practice under the supervision of a member who holds a General or Academic certificate of registration in order to meet requirements imposed by the Registration Committee for qualification for a General certificate of registration.

2.  The applicant is a Canadian citizen or a permanent resident of Canada or authorized under the Immigration and Refugee Protection Act (Canada) to enrol in a course referred to in subparagraph i of paragraph 1 or to engage in the supervised practice referred to in subparagraph ii of paragraph 1.  O. Reg. 830/93, s. 6 (1); O. Reg. 111/94, s. 2; O. Reg. 92/12, s. 6.

(2) The requirement in paragraph 1 of subsection (1) is non-exemptible.  O. Reg. 830/93, s. 6 (2).

(3) Where an applicant previously held an Educational certificate in order to meet the requirements imposed by the Registration Committee for qualification for a General certificate, the Educational certificate may be issued only with the approval of the Registration Committee, in accordance with the Committee’s policy guidelines.  O. Reg. 830/93, s. 6 (3).

6.1 (1) The following are specific requirements for an Emergency certificate of registration:

1.  The Minister has requested the College to initiate registrations under this class based on the Minister’s opinion that emergency circumstances call for it, or Council has determined, after taking into account all of the relevant circumstances that impact the ability of applicants to meet the ordinary registration requirements, that there are emergency circumstances, and that it is in the public interest that the College issue emergency certificates.

2.  The applicant meets the requirement of paragraph 1 of subsection 4 (1).

3.  The applicant meets the requirement of paragraph 2.1 of subsection 4 (1). O. Reg. 276/23, s. 3.

(2) Subject to subsection (3), the requirements of subsection (1) are non-exemptible. O. Reg. 276/23, s. 3.

(3) Where the applicant is registered or licensed as a podiatrist in a jurisdiction approved by the Council, the applicant is deemed to have met the requirement of paragraph 2 of subsection (1). O. Reg. 276/23, s. 3.

7. The following are conditions to maintain a certificate of registration of any class:

1.  The member shall provide the College with details of any of the following that relate to the member including any that occur or arise after the registration of the member:

i.  a finding of guilt in relation to a criminal offence, an offence under the Controlled Drugs and Substances Act (Canada) or the Food and Drugs Act (Canada) or any other offence relevant to suitability to practise,

ii.  a finding of professional misconduct, incompetence or incapacity, in Ontario in relation to another health profession or in another jurisdiction in relation to chiropody or another health profession, or

iii.  a proceeding for professional misconduct, incompetence or incapacity, in Ontario in relation to another profession or in another jurisdiction in relation to chiropody or another health profession.

2.  The member shall not make a false or misleading statement or representation in his or her annual information return.

3.  Where, in the opinion of the Registration Committee, the member’s education was incomplete in one or more aspects, the member shall abide by any terms, conditions and limitations imposed by the Registration Committee on his or her certificate of registration until the member meets the educational requirements set by the Committee.  O. Reg. 830/93, s. 7; O. Reg. 92/12, s. 7.

8. (1) The following are specific conditions to maintain a General certificate of registration:

1.  If the member has not practised as a chiropodist for a period or periods of at least three months during the previous two years, the member shall not engage in the practice of chiropody until the member satisfies the Registration Committee that he or she is competent to do so.

2.  The member’s certificate of registration is revoked if the member ceases to be a Canadian citizen or a permanent resident of Canada or to be authorized under the Immigration and Refugee Protection Act (Canada) to practise the profession in Canada.  O. Reg. 830/93, s. 8 (1); O. Reg. 92/12, s. 8 (1).

(2) The condition in paragraph 2 of subsection (1) does not apply if the member was not required to be a Canadian citizen or permanent resident of Canada or to be authorized under the Immigration and Refugee Protection Act (Canada) to practise the profession in Canada when the member obtained his or her certificate of registration.  O. Reg. 830/93, s. 8 (2); O. Reg. 92/12, s. 8 (2).

9. (1) The following are specific conditions to maintain an Academic certificate of registration:

1.  The member may engage in the practice of chiropody only within the scope of his or her appointment.

2.  The member shall not charge or accept a fee for the performance of any chiropody service provided to a patient.

3.  The member’s certificate of registration is revoked when the member no longer holds an appointment described in paragraph 2 of subsection 5 (1).

4.  The member’s certificate of registration is revoked if the member ceases to be a Canadian citizen or a permanent resident of Canada or ceases to be authorized under the Immigration and Refugee Protection Act (Canada) to engage in the appointment described in paragraph 2 of subsection 5 (1).  O. Reg. 830/93, s. 9 (1); O. Reg. 92/12, s. 9 (1).

(2) The condition in paragraph 4 of subsection (1) does not apply if the member was not required to be a Canadian citizen or permanent resident of Canada or to be authorized under the Immigration and Refugee Protection Act (Canada) to engage in the appointment described in paragraph 2 of subsection 5 (1) when the member obtained his or her certificate of registration.  O. Reg. 830/93, s. 9 (2); O. Reg. 92/12, s. 9 (2).

10. (1) The following are specific conditions to maintain an Educational certificate of registration:

1.  The member may engage in the practice of chiropody only in the course of his or her enrolment in a post-secondary program in Ontario referred to in subparagraph i of paragraph 1 of subsection 6 (1) or under the supervision of a member who holds a General or Academic certificate of registration in order to meet the requirements imposed by the Registration Committee for qualification for a General certificate of registration.

2.  The member shall not charge or accept a fee for the performance of any chiropody service provided to a patient.

3.  The member’s certificate of registration is revoked when the member ceases to be enrolled in a post-secondary program in Ontario referred to in subparagraph i of paragraph 1 of subsection 6 (1) or, where the certificate was issued to a member in order to meet the requirements imposed by the Registration Committee for qualification for a General certificate, on the first anniversary date of the certificate.

4.  The member’s certificate of registration is revoked if the member ceases to be a Canadian citizen or a permanent resident of Canada or ceases to be authorized under the Immigration and Refugee Protection Act (Canada) to be enrolled in a post-secondary institution as described in paragraph 1.  O. Reg. 830/93, s. 10 (1); O. Reg. 92/12, s. 10 (1).

(2) The condition in paragraph 4 of subsection (1) does not apply if the member was not required to be a Canadian citizen or permanent resident of Canada or to be authorized under the Immigration and Refugee Protection Act (Canada) to be enrolled as described in paragraph 1 of that subsection when the member obtained his or her certificate of registration.  O. Reg. 830/93, s. 10 (2); O. Reg. 92/12, s. 10 (2).

10.1 (1) The following are specific conditions to maintain an Emergency certificate of registration:

1.  The member may engage in the practice of chiropody only under the supervision of a member who holds a General certificate of registration and who has been approved by the Registrar to supervise a member of the Emergency class.

2.  The member may engage in the practice of chiropody only while holding themselves out as a member of the Emergency class (chiropodist) who is practising under supervision.

3.  The Emergency certificate of registration is automatically revoked 60 days after the Council determines that the emergency circumstances referred to in paragraph 1 of subsection 6.1 (1) have ended.

4.  The Emergency certificate of registration expires one year from the date on which the certificate was issued, unless extended by the Registrar, if the Council has not determined that the emergency circumstances have ended.

5.  The Emergency certificate of registration shall be revoked prior to its expiry if, in the opinion of the Registrar or the Registration Committee, it is in the public interest to do so. O. Reg. 276/23, s. 4.

(2) The Registrar may extend an Emergency certificate of registration for one or more periods, each of which is not to exceed one year, if the Council has not determined the emergency circumstances have ended. O. Reg. 276/23, s. 4.

11. If the Registrar suspends a member’s certificate of registration for failure to pay a prescribed or required fee, the Registrar shall lift the suspension on the payment of,

(a)  the fee the member failed to pay;

(b)  the annual fee payable for the year in which the member wishes to register; and

(c)  any applicable penalties.  O. Reg. 830/93, s. 11; O. Reg. 386/06, s. 2.

12. Where the Registrar has suspended a member’s certificate of registration for failure to pay a prescribed or required fee, and the suspension remains in effect for a period exceeding two years, the certificate is automatically revoked.  O. Reg. 830/93, s. 12; O. Reg. 386/06, s. 3.

13. A member whose certificate of registration was revoked under section 12 or who resigned while in default of a fee owed to the College, and who applies to be reinstated is required to satisfy the requirements for the class of certificate for which reinstatement is sought and to pay,

(a)  the application for reinstatement fee;

(b)  the fee the member failed to pay;

(c)  the annual fee payable for the year in which the member wishes to be reinstated; and

(d)  any applicable penalties.  O. Reg. 830/93, s. 13; O. Reg. 386/06, s. 4.

14. Revoked:  O. Reg. 386/06, s. 5.

15. (1) A member who, on December 30, 1993, held a certificate of registration under subsection 3 (1), (3) or (4) of Regulation 73 of the Revised Regulations of Ontario, 1990, shall be deemed to hold a General certificate of registration.  O. Reg. 187/99, s. 1.

(2) A member who, on December 30, 1993, held a certificate of registration under subsection 3 (1) of Regulation 73 of the Revised Regulations of Ontario, 1990, shall be deemed to be a member of the podiatrist class.  O. Reg. 187/99, s. 1.

15.1 (1) A person who, at the time of resigning as a member, held a general certificate of registration may be reinstated if he or she,

(a)  submits a completed application for reinstatement in the form provided by the Registrar and the required application fee;

(b)  pays the annual fee for the year in which he or she wishes to be reinstated and any other outstanding fees owing to the College; and

(c)  meets the requirements set out in section 3 and paragraphs 3 and 5 of subsection 4 (1).  O. Reg. 187/99, s. 2.

(2) The application fee is non-refundable but the amount of the fee is deductible from the amount of the annual fee payable under clause (1) (b).  O. Reg. 187/99, s. 2.

15.2 (1) A person who, at the time of resigning as a member, held an academic certificate of registration may be reinstated if he or she,

(a)  submits a completed application for reinstatement in the form provided by the Registrar and the required application fee;

(b)  pays the annual fee for the year in which he or she wishes to be reinstated and any other outstanding fees owing to the College; and

(c)  meets the requirements set out in section 3 and paragraphs 2 and 4 of subsection 5 (1).  O. Reg. 187/99, s. 2.

(2) The application fee is non-refundable but the amount of the fee is deductible from the amount of the annual fee payable under clause (1) (b).  O. Reg. 187/99, s. 2.

15.3 A person who, at the time of resigning as a member, was a member of the podiatrist class may be reinstated in the podiatrist class if he or she,

(a)  meets the requirements set out in sections 15.1 and 15.2; and

(b)  was registered in the podiatrist class on December 30, 1993.  O. Reg. 187/99, s. 2.

15.4 Sections 15.1, 15.2 and 15.3 do not apply to a member whose certificate of registration was suspended or revoked.  O. Reg. 187/99, s. 2.
