General

Definition

1.  In this Regulation,

“construction” includes erection, installation, expansion, refurbishment, alteration and repair.

Financing for municipalities

2. Subject to section 7, the Corporation may provide financing to municipalities for capital expenditures relating to infrastructure projects and acquisitions including, but not limited to, infrastructure projects and acquisitions relating to any of the following:

1. Fire stations and fire fighting equipment.

2. Police stations and policing equipment.

3. Ferries and docks.

4. Airports.

5. Administration buildings.

6. Energy conservation projects.

7. Water works for clean water.

8. Sewage works.

9. Waste management systems.

10. Highways that are under municipal jurisdiction.

11. Public transit vehicles and systems.

12. Tourism, culture and recreation.

13. Ambulances.

14. The refurbishment or repair of housing projects that, on or before August 20, 2004, were subject to the Social Housing Reform Act, 2000.

Financing for universities and post-secondary institutions

3.  (1) The universities, their federated and affiliated colleges and universities and other post-secondary educational institutions, all of which are listed in Schedule 1 to this Regulation, are specified as public bodies for the purposes of paragraph 1 of section 3 of the Act.

(2) Subject to section 7, the Corporation may provide financing to the public bodies specified in subsection (1) for capital expenditures relating to infrastructure projects and acquisitions including, but not limited to, infrastructure projects and acquisitions relating to any of the following:

1. Water works for clean water.

2. Sewage works.

3. University and college roads and parking lots.

4. On campus health care facilities.

5. Energy conservation projects.

6. Academic teaching facilities.

7. Research facilities.

8. Student residences.

9. Daycare facilities.

10. Recreation and sport facilities.

Financing of corporations held by municipalities

4. (1) Corporations incorporated pursuant to section 2 of Ontario Regulation 168/03 (Municipal Business Corporations) made under the Municipal Act, 2001, all of the shares of which are held directly or indirectly by one or more municipalities, are specified as public bodies for the purposes of paragraph 1 of section 3 of the Act.

(2) Subject to section 7, the Corporation may provide financing to the public bodies specified in subsection (1) for capital expenditures relating to infrastructure projects and acquisitions including, but not limited to, infrastructure projects and acquisitions relating to any of the following:

1. Water works for clean water.

2. Utilities.

3. Public transit projects.

Financing for not-for-profit long-term care providers

5. (1) Not-for-profit long-term care providers are specified as public bodies for the purposes of paragraph 1 of section 3 of the Act.

Examples

(2) The following are examples of not-for-profit long-term care providers that are specified as public bodies under subsection (1):

1. A corporation approved under section 2 of the Charitable Institutions Act for persons requiring long term care or a corporation approved under an equivalent section in successor legislation to that Act.

2. A licensee under the Nursing Homes Act or successor legislation to which Part III of the Corporations Act applies.

3. A municipality maintaining and operating a home, a municipality maintaining and operating a joint home or the board of management of a home, in each case under the Homes for the Aged and Rest Homes Act or successor legislation.

(3) Subject to section 7, the Corporation may provide financing to the public bodies specified in subsection (1) for capital expenditures relating to infrastructure projects and acquisitions including, but not limited to, infrastructure projects and acquisitions relating to the acquisition or construction of a long-term care home.

(4) In this section,

“long-term care home” means a home approved under the Charitable Institutions Act, a nursing home within the meaning of the Nursing Homes Act and a home under the Homes for the Aged and Rest Homes Act or an equivalent home under successor legislation to those Acts.

Financing for other corporations

6. (1) Corporations incorporated pursuant to section 142 of the Electricity Act, 1998, all the shares of which are held by one or more municipal corporations and corporations incorporated as local housing corporations pursuant to Part III of the Social Housing Reform Act, 2000 are specified as public bodies for the purposes of paragraph 1of section 3 of the Ontario Infrastructure Projects Corporation Act, 2006.

(2) Corporations that meet the following criteria are specified as public bodies for the purposes of paragraph 1 of section 3 of the Act:

1. The corporation must be incorporated by statute.

2. The shares of the corporation must be held by one or more municipalities or by a municipal corporation, all of whose shares are held by one or more municipalities.

3. The municipality or municipal corporation must hold the shares either alone or together, in each case, with one or both of the Crown in right of Ontario and the Crown in right of Canada.

4. The shares may be held, in each case, directly or indirectly.

5. All of the shares of the corporation must be held as described in paragraphs 2, 3 and 4.

(3) Subject to section 7, the Corporation may provide financing to the public bodies specified in subsections (1) and (2).

Restriction

7. The Corporation shall not provide financing to a municipality or other public body unless the proposed financing is authorized by the municipality or public body and is consistent with the terms of any legislation governing the municipality or public body.

Revocation

8. Ontario Regulation 109/03 is revoked.
