Amending Reg. 369 of R.R.O. 1990

1. Clause 4 (1) (b) of Regulation 369 of the Revised Regulations of Ontario, 1990 is amended by adding “and” at the end of subclauses (iii) and (iv) and by revoking subclauses (v) and (vi).
2. Clause 4 (1) (c) of the Regulation is amended by revoking subclause (i), by adding “and” at the end of subclause (ii), by striking out “and” at the end of subclause (iii) and by revoking subclause (iv).
3. Clause 4 (2) (b) of the Regulation is amended by adding “and” at the end of subclauses (ii) and (iii) and by revoking subclauses (iv) and (v).
4. Subclauses 4 (2) (c) (i) and (ii) of the Regulation are revoked.
5. Clause 7 (2) (b) of the Regulation is amended by striking out “as approved by the Director”.
6. Subsection 7 (3) of the Regulation is revoked.
7. Subsection 11 (2) of the Regulation is amended by striking out the portion before clause (a) and substituting the following:
(2) On and after June 15, 2005, a dealer shall ensure that a tractor manufactured after January 1, 1992 and sold or offered for sale shall be equipped with,
. . . . .
8. (1) Subsection 11 (3) of the Regulation is revoked and the following substituted:
(3) A dealer shall ensure that a rollover protective structure on a tractor complies with,
(a) the provision referred to in Item 1 of the Table to this section in the column that applies to the tractor; or
(b) the provision referred to in Item 2 of the Table to this section in the column that applies to the tractor and,
(i) the standard referred to in Item 3 of the Table to this section in the column that applies to the tractor,
(ii) the standard referred to in Item 4 of the Table to this section in the column that applies to the tractor, or
(iii) one of the standards referred to in Item 5 of the Table to this section in the column that applies to the tractor.
(2) Section 11 of the Regulation is amended by adding the following Table:

9. Subsection 11.1 (3) of the Regulation is amended by striking out “Farm Implements Act Program, Environmental Policy and Programs Branch, Ministry of Agriculture and Food” and substituting “Ministry of Agriculture, Food and Rural Affairs, Farm Implements Act Program”.
10. This Regulation comes into force on July 1, 2010.
