Amending O. Reg. 134/98

(General)

1. Subsection 38 (1) of Ontario Regulation 134/98 is revoked and the following substituted:

(1) Subject to subsections (2) and (3), the prescribed limit for assets for a benefit unit, for the purposes of clause 7 (3) (b) of the Act, is equal to,

(a) if the applicant or recipient is a single person, $592;

(b) if the applicant or recipient has a spouse included in the benefit unit and there are no other dependants, $1,021;

(c) if the applicant or recipient has a spouse included in the benefit unit and there are one or more other dependants, $1,708 for the applicant or recipient, the spouse and one other dependant plus $500 for each additional dependant;

(d) if the applicant or recipient has no spouse included in the benefit unit and there are one or more dependants, $1,632 for the applicant or recipient and one dependant plus $500 for each additional dependant; and

(e) if the applicant or recipient is a person to whom subsection 11 (2) or (4) applies, $500 for each dependent child.

2. (1) The Table to paragraph 1 of subsection 41 (1) of the Regulation is revoked and the following substituted:

For each additional dependant of a sole support parent:

add $103 if the dependant is 18 years of age or older,

add $59 if the dependant is 0 - 17 years of age.

Otherwise, for each additional dependant:

add $89 if the dependant is 18 years of age or older,

add $52 if the dependant is 0 - 17 years of age.

(2) The Table to paragraph 2 of subsection 44 (1) of the Regulation is revoked and the following substituted:

For each additional dependant, add $41.

(3) Paragraph 4 of subsection 44 (1) of the Regulation is amended by striking out “$35” at the end and substituting “$36”.

(4) Paragraph 5 of subsection 44 (1) of the Regulation is revoked and the following substituted:

5. $61 (Special Boarder Allowance).

(5) Paragraphs 1, 2, 3 and 4 of subsection 44 (2) of the Regulation are revoked and the following substituted:

1. $231 for the first dependant of the dependant.

2. $98 for the second dependant of the dependant.

3. $117 for each subsequent dependant of the dependant.

4. If the applicant or recipient resides north of the 50th parallel and is without year-round road access, an additional amount equal to the sum of $92 for the first dependant of the dependant and $41 for any subsequent dependant of the dependant.

(6) The Table to paragraph 1 of subsection 44 (3) of the Regulation is revoked and the following substituted:

(8) Paragraph 4 of subsection 44 (3) of the Regulation is revoked and the following substituted:

6. (1) Subsection 44.1 (2) of the Regulation is revoked and the following substituted:

(2) After three months of determining in accordance with subsection (1) the budgetary requirements of an applicant or recipient to whom that subsection applies, the administrator may reduce the budgetary requirements of the applicant or recipient to an amount that is,

(a) not less than the sum of $128 for each member of the benefit unit, with respect to determinations relating to a month after November 30, 2009 and before December 1, 2010; and

(b) not less than the sum of $130 for each member of the benefit unit, with respect to determinations relating to a month after November 30, 2010.

(2) Subsection 44.1 (3) of the Regulation is amended by striking out “$128” and substituting “$130”.

7. Subparagraph 2 i of subsection 49 (1) of the Regulation is revoked and the following substituted:

i. is the actual amount paid, if those expenses are paid,

A. to a person licensed under the Day Nurseries Act, and

B. to a board, within the meaning of the Education Act, for an extended day program operated by the board under the Education Act, and

8. The Table to subparagraph 1 ii of section 51 of the Regulation is revoked and the following substituted:

For each additional dependant:

add $155 if the dependant is 18 years of age or older,

or $0 if the dependant is 0-17 years of age.

The amount attributable to a dependent child shall be reduced by 50 per cent where budgetary requirements for the child were reduced under section 44.2.

9. (1) Subsection 52 (1) of the Regulation is amended by adding the following paragraph:

15. Subject to subsection (2), a payment under the Ministry of Municipal Affairs and Housing’s Short Term Rent Support Program.

(2) Section 52 of the Regulation is amended by adding the following subsection:

(2) The maximum amount of the payment permitted for the purposes of paragraph 15 of subsection (1) is the amount by which the actual cost of shelter, determined in accordance with subsection 42 (1), exceeds the amount payable for shelter under subsection 42 (2).

10. Paragraph 5 of subsection 55 (1) of the Regulation is amended by striking out “$72” and substituting “$73”.

11. Clauses 57 (5) (a) and (b) of the Regulation are revoked and the following substituted:

(a) $308 for the first child and $251 for each additional child if the adult applicant or recipient resides north of the 50th parallel and is without year round road access;

(b) $244 for the first child and $198 for each additional child if clause (a) does not apply;

12. (1) Subject to subsections (2), (3) and (4), this Regulation comes into force on December 1, 2010.

(2) Section 9 is deemed to have come into force on July 1, 2010.

(3) Section 7 is deemed to have come into force on September 1, 2010.

(4) Section 12 comes into force on the day this Regulation is filed.
