Geographic division of province

1. (1) Ontario may be divided into such geographic areas and with such names as may be prescribed by regulation. 2002, c. 17, Sched. E, s. 1 (1).

Status, etc., of municipality unaffected

(2) The status, name or boundary of any municipality, except where otherwise provided, is unaffected by this Act, a regulation made under this Act or the repeal of the Territorial Division Act. 2002, c. 17, Sched. E, s. 1 (2).

Regulations

2. (1) The Minister of Municipal Affairs and Housing may make regulations dividing all of Ontario into geographic areas and establishing the boundaries of and naming those areas. 2002, c. 17, Sched. E, s. 2 (1).

Scope

(2) A regulation under subsection (1),

(a) may incorporate by reference, in whole or in part, any document, map or description;

(b) may describe a geographic area using the names of municipalities;

(c) may prescribe different geographic areas for different purposes, including prescribing for the purposes of a provision of any Act or regulation, unless otherwise provided, that a single-tier municipality is, for geographic purposes, included within an upper-tier municipality or another single-tier municipality. 2002, c. 17, Sched. E, s. 2 (2).

Changes to municipalities

(3) The inclusion of the name of a municipality in a prescribed geographic area does not prevent the name, status or boundaries of any municipality being changed as provided for under any Act. 2002, c. 17, Sched. E, s. 2 (3).

Lakes and rivers forming boundary

3. (1) The limits of a geographic township lying on a river or lake that forms part of the boundary of Ontario or the boundary of another province extend to that boundary in the lake or river in prolongation of the outlines of the township and that township also includes all the islands, the whole or the greater part of which are comprised within the outlines so prolonged. 2002, c. 17, Sched. E, s. 3 (1).

Limits of townships on bays, lakes and rivers

(2) The limits of geographic townships on rivers, lakes and bays, other than those to which subsection (1) applies, extend to the middle of the lakes and bays, and to the middle of the main channels of the rivers and include every island the whole or the greater part of which is comprised within the outlines of the townships so prolonged. 2002, c. 17, Sched. E, s. 3 (2).

Exception, Carling and McDougall

(3) Despite subsection (2),

(a) the extended east limit of the Township of Carling and the extended west limit of the Township of McDougall in the waters of Parry Sound are defined by a line drawn south 20^o 52′ east astronomically from the southeast corner of Lot 6, Concession 10, in the Township of Carling;

(b) the extended south limits of the townships of McDougall and Carling and the extended north limit of the Township of Cowper in the waters of Parry Sound and the Georgian Bay are defined by a line drawn south 69^o 8′ west astronomically from the southwest corner of the Township of McDougall; and

(c) the townships of Carling, McDougall and Cowper include every island the whole or the greater part of which is included within the limits of the townships. 2002, c. 17, Sched. E, s. 3 (3).

Exception, Baxter and Tay

(4) Despite subsection (2), the extended south limit of the Township of Baxter and the eastern portion of the extended north limit of the Township of Tay in the waters of the Georgian Bay from the mouth of the Severn River are defined as follows:

1. Commencing at a point in the waters of the Georgian Bay distant 94 chains, measured on a course of south 20^o 52′ east from the northeast corner of Lot 31, Concession 2, in the Township of Baxter; then north 80^o west astronomically 109 chains more or less to a point in a line drawn south astronomically from the southwestern extremity of Potato Island; then west astronomically 210 chains more or less to a point in the waters of the Georgian Bay midway between the mainland of the Township of Tay and the Township of Baxter.

2. Again commencing at the point of commencement; then north 62^o east astronomically 40 chains more or less to a point in the waters of the Georgian Bay midway between the mainland of the Township of Baxter and the Township of Tay; then northerly and westerly following the midway line between the mainland of the Township of Baxter and the Township of Tay to the intersection with the centre of the main channel of the Severn River at the mouth of the Severn River.

3. The townships of Baxter and Tay include every island the whole or the greater part of which is included within the limits of the townships. 2002, c. 17, Sched. E, s. 3 (4).

Exception, islands

(5) This section does not apply to islands or parts of islands,

(a) that are townships by themselves; or

(b) that have been expressly included in other townships by statute or in the original surveys, which plans of survey are held by the Ministry of Natural Resources. 2002, c. 17, Sched. E, s. 3 (5).

Continuation

4. Despite the repeal of the Territorial Division Act, until a regulation is made under section 2, Ontario continues to be divided into the areas described in the Schedule to that Act. 2002, c. 17, Sched. E, s. 4.
